Scope of Clerk Services

Court staff can only provide informational assistance. They cannot provide legal assistance or advice.

Court Staff Will Provide:

• Assistance with research and case lookup.

• Information on case status, unless the case is sequestered [not available for public inspection].

• Copying, duplication and certification services.

• Information about Court schedules.

• General information about Court procedures and policies.

• Court approved forms.

• Scheduling for interpreter services.

Court Staff Will Not Provide:

• Any legal advice.

• Advice whether to file a case.

• Advice whether to take any action in a case.

• Assistance filling out forms for you or advice for what to state on a form.

• Advice for what to say in court.

• Speculation about a judge's decision, sentencing or when a judge will sign court documents.

Methods of Payment

Personal checks are not accepted. Acceptable forms of payment are: Cash, money order or cashier's check. Make money orders payable to the 12th Judicial District Court. We do not accept credit cards.

Case Inquiry      Online Case Lookup

The Court Clerk's staff can assist you in obtaining case information, case status and scheduling information. Case lookup also is available online from the New Mexico State Courts Web site. Case lookup can be performed based on the name of any one of the parties, but research may be easier and faster if you can provide the full case number. Case numbers are comprised of five sections, for example: D-1215-CV-2006-00999

 

 

D indicates District Court.

1215 indicates the county code: Lincoln County is 1226 and Otero County is 1215.

CV indicates the case category, for example CV for Civil and CR for Criminal.

2006 indicates the year the case was filed.

00999 indicates a numerical ID assigned to the case when it was filed.

You must complete a Request for Tapes/Copies form and submit it to the Clerk's office to request copies of court documents or tapes. You can submit the form in person, by mail or by facsimile. Requests generally are processed within 24 hours, but may take longer if extensive research is required.

The Court requires that fees be received prior to completing your service request. Clerk's staff will contact you regarding fees and advise you of the total cost.

You can pick up your order in person or have it mailed to you. For mail delivery, send payment in the form of a money order or cashier's check, and include a self-addressed, stamped envelope.

Interpreters       Lincoln County Forms       Otero County Forms

If you need interpreter services, you must fill out a Request for Interpreter form and submit it to the Clerk's office. Please submit your request at least 48 hours prior to the hearing to provide time to schedule with the interpreter.

To cancel a request for an interpreter, a Cancellation of Interpreter form must be submitted to the Clerk's office. If the form is not received at the Clerk's office 24 hours prior to the scheduled hearing, you will be required to pay for interpreter services.

Mediation

The Court has a domestic relations mediation program. Domestic relations cases involving children may be mediated. The court Clerk's office can provide a list of mediators. For additional information on domestic relations mediation, contact the Clerk's office.

Bonds

Cash bonds are payable at the Clerk's Office.

Cash bonds may be returned to the individual who posted the bond after the defendant has appeared at all required hearings. The person who posted the bond must file both a Motion and an Order with the Court to release bond monies. Once the Order has been approved, the Court Financial Department will process the bond refund.
